California Reference re: Marriage Cases: Freedom from Discrimination

In the Reference re: Marriage Cases, the Court of Appeal for the State of California considered whether California’s marriage laws were discriminatory on the basis of sexual orientation. In 2006, as an amicus curiae, the IHRP urged the Court to interpret discrimination in light of comparative law from Canada and international human rights law obligations.
